· The regulations for dietary supplements are binding and the regulations of Codex are fairly difficult to follow.
·Unless and until a new supplement has undergone an then passed Codex testing, it would be automatically banned and never allowed to enter the market.
·The testing standards of Codex are very stringent and often biased in their approach.
· Food items which are genetically altered would be permitted to be sold throughout the world without the need for labelling.
The Drawback of Codex:
If Codex is allowed to function in the United States health supplement market then amino acids, herbs, minerals, homeopathic medications and all sorts of natural cures which you have often considered as a part of your daily life would be snatched from your grasp. The main aim of Codex is to simply shift all the supplements which fall under health related remedies into prescription drugs and once that happens, you would never find a single body building supplement available in the market. Those that are available would require you to get hold of a doctor’s prescription. It has come to our notice that the American FDA plans to sanction a new law which would allow them to have complete control over the manufacturing, sale as well as purchase of holistic healing products and natural as well as organic supplements. Also known as ‘Docket No 2006D-0480’, this document is a draft guidance which is based on the theme that the market which deals with the manufacturing as well as the distribution of affordable holistic alternatives needs to be reformed as per the guidelines laid down by the American FDA. As many of us may already be aware, the attitude of the FDA towards the use of alternative health options is not positive. The question now arises whether we (the American public) should allow such an act to be passed in the first place?
Well, of course you are well aware that this act is unacceptable but what can you do to stop this from happening? Well, to stop this act from being passed, you need to sign petitions and send your opinion to the FDA, as they do accept written and signed petitions from the general public. These application forms are available till April 30th, after which the act would become a rule. So, if you care about the freedom of consumers, then you need to try and make an effort on your part. You need to ACT now and you can do this by simply making your voice heard.

What Is Operation Cure All?
Operation Cure is a seemingly disturbing proposal which was initiated by the government authorities FDA as well as the FTC. The main purpose of Operation Cure is to put a leash on the thriving online supplements industry, with special regards to the health and fitness segment. But the fact remains that this is an unscrupulous proposal, which if converted into a full fledged act would create lots of problems for both the aspiring athletes (including bodybuilders) as well as individuals who are involved in the health supplement manufacturing industry. Apparently, this is a ridiculous suggestion on the part of FDA as well as the FTC as this proposal would simply aim at curing themselves off all competition and its repercussions on the health industry would be terrible. ironical? While the statement is worth commending, it is very difficult to even understand what it means and how it fits into the health supplements segment. In simple words-I don’t even know what it means-do you?
What I understood was that each health product needs to be backed with intensive research, clinical studies, tests and researches, without which the health supplement may not be allowed to enter the markets. The problem here lies in our qualifications as well as our lack of monetary constraints. I’m sure most of us are not qualified enough to conduct a clinical research on our products and neither do we have enough funds to invest in terms of hiring a qualified scientist to do the needful for us. Actually, as per the law, we would have to hire a scientist each time we submit a testimonial.
Another problem which we are facing is the legality of the testimonials. The entire world including the FDA and the FTC are aware that most testimonials are not legal, yet they are completely safe for human consumption. So, if this law is allowed to pass, we would have to stop production of these supplements which is our bread and butter and the livelihood of millions of aspiring athletes across the globe. This is not at all fair-what do you think?
The third problem with the so called ‘one sided’ proposal is in terms of the structure. Well, if you read through the structure column of the proposed rule book, you would notice that all testimonials need to be structured in a particular manner and that an average person would never be able to fill the structure and function’s criteria. Even if someone is aware of all the stringent rules that are being applied towards the drastic changes in the health supplement market, very few would be able to provide an acceptable testimony. In fact, only a skilled lawyer would be able to do so and that costs a lot of money.
As very few testimonials are legal, it is highly likely that most health supplements would be shunted out of the health sector. Even if the testimony is structured in accordance with the structure laid down by FDA then also you need to send a detailed report filed with the FDA within 30 days of compiling it. It is clearly evident now that the government has found a suitable way to shackle the internet health industry so that their products remain unheard of for ever.
Another rule in the guise of ‘deception’ is the fact that advertising should not be misleading. As per the new law, it has become illegal for websites to mention the names of chronic conditions such as cancer, arthritis, cardiac diseases, headaches and even pain anywhere in the website. In fact, you should also try and get it removed from the testimonials. But in reality, this cannot be removed as symptoms pertaining to a particular disease need to be mentioned. For example, “smoking is injurious to an individual’s lung”, would be considered as an illegal statement. According to the FDA regulations, this is considered as an impressionable disease claim.
In a nutshell, there should be no relationship between disease condition and a supplement. Interestingly, pregnancy, menstrual cycle and even menopause are considered as diseases. It would be exceedingly difficult for alternate health websites to prove that their product is worth purchasing, as we would not be able to explain the true potential of our supplement without describing it in an appropriate manner.
It is really funny to note that if a supplement is considered as a means of curing, treating, preventing or even mitigating a disease, the product would automatically lose its status as a supplement and as per the proposed rules of the FDA, would be considered as a drug. Once it has been categorized as a drug, it must pass through the FDA’s stringent laws and it can only be used when the supplement has been certified for its safety and effectiveness. The review process is incredibly lengthy, expensive and rigorous and not even drug companies would want to go through it. But till this process is not fully completed, the FDA would consider the supplement as an approved drug, which may never be allowed to circulate in the health markets. If for any reason the marketer decides to distribute the drug without undergoing the painstaking procedure then the supplement can be seized by the FDA and stopped from being distributed online.
This undoubtedly is the strong arm tactic devised by the FDA authorities to pressurize the internet marketing companies to give up their businesses altogether. The reason why FTA and the FTC have taken this stand is to ensure that internet marketers do not make use of misleading as well as deceptive statements to lure customers to their products. Well, are the customers so naïve that they would purchase a product which is not good in terms of quality? Well, of course they are an aware lot and can take the right decision for themselves. FDA continues to argue its point stating that it would not allow the use of deception for the sale of products and it even considers simple terms such as “secret ingredients”, “exclusive products” and “ancient remedies” as misleading terms that have no meaning in the scientific world. Now, isn’t this simply hilarious!
In order to clarify this for the FDA, let me clearly state that these terms do not have any relationship with the so called “scientific terminology” and they are simply used to explain the product in a simplified manner. Can you ever consider a term “ancient remedy” as a scientific term? You always find these terms used blatantly in various books, sales letters and even the daily newspapers. I believe no one would be naïve enough to search for them in the researcher’s directory. My argument is based on the fact that when the government knows that this is an advertising tool which all
other companies use on a regular basis then why should the internet industry is banned from doing the same. Are they under the impression that you cannot sell a genuine product or are they trying to imply that you would not be able to sell a genuine product because of the imposed restrictions?
I’m sure each and every one of us here must be aware that FDA has given approval to the drug companies to advertise their prescribed medications in the form of television commercials and ads in the magazines. While television viewers are provided with this information day in and day out, the FDA plans to suppress all the information which is related to natural health products. Why would they want to do so? Well, the answer is very simple and you need not be a scientist to realize the game that is being played here.
The claim of FDA is that people may cancel their surgical as well as chemotherapy options in favour of herbal medications and the FDA further claims that the traditional surgical as well as chemotherapy procedures are available for just a few hundred dollars only. What I would like the FDA to do is to spend five minutes of their precious time in calculating the total expenditure which is involved in surgery, chemotherapy as well as the radiation therapy. It would not be hundreds of dollars as the FDA had predicted but would run into tens of thousands of dollars. Why is the government not concerned with the high costs of the modern medication procedures?
Do you realize that an entire industry is profiting from the deals FDA is protecting. Take for example a cancer hospital and the staff and furniture it has. That must have been bought from somewhere. Then the medicines that are used for chemo- would that also not involve the drug industry. Then you take a closer look at the finishing schools that train doctors and nurses-would they not be making out of the entire deal? Last but not the least, take a closer look at the insurance companies-what do you think about them? In a nutshell, they all make money from the modern medication procedures and all those that are involved in this process are mainly doing so for the sake of instant profits. So, do you see any harm in internet marketers selling alternative health products? I guess not!
Just after reading through the above paragraph, you must have come to know the immense scope of the cancer industry with special regards to the monetary benefits involved. When the government is quite comfortable with the entire process then why should they be worried about natural healing products as well as natural body building supplements which cost only a few hundred dollars to be sold via the World Wide Web?
The only reason why the FDA is doing this is because they have realized that the sales in the health sector with special regards to body building supplements is increasing at warp speed and this in turn is diminishing the sales of the expensive modern medications.
Hence, the concerned authorities are uncertain how they can further brainwash the minds of an aware public. As they were unable to convince the public regarding the effectiveness of modern medication techniques, they have decided to come up with a new technique with which they can hope to cripple the natural health products industry permanently.
Colloidal Silver is yet another device which is protected by the FDA and I had an opportunity to try that as well. While it never really did any benefit to my body, it never really harmed me either. I firmly believe that there is no need for a government policy for a product that is harmless and there is also no need for any government restriction when the question revolves around my personal decision. Another interesting fact I would like to share with you is the use of St. John’s Wort medication. This is mainly used for treating patients who are suffering from HIV AIDS but in all honesty, do you think that the HIV patients only make use of St. John’s Wort medication and that they do not take a natural alternative along with it? If they are using a natural alternative as well, would the government ban St. John’s Wort medicine? Of course they would not. So, why should they try and ban natural health products including body building supplements. I believe each individual should have a right to choose the supplement of his/her choice.
I was in for a shock when I picked up the People’s magazine a few days ago and saw a two page ad which clearly suggested that people should discredit undocumented as well as unsubstantial claims by health companies. They also suggested that people first refer to their doctors before making use of a health
supplement or by paying a visit to the government website. A discussion with the doctor is not an ideal solution to such claims because not many doctors would be aware of the availability of health products. At the same time, how many doctors would have complete knowledge on nutrition because most doctors simply specialize in a single field of nutrition. At the same time, do you even think that doctors would be interested in natural health alternatives seeing the fact that they are paid enormous amounts by the drug companies in the form of bonuses and incentives to promote their form of medication? In fact most doctors even get an all expense paid trip to exotic locales for their training. How many doctors would even care that the medicines they are giving for the improvement of your cardiac problems can damage your gastrointestinal tract and even your liver?
According to the Journal of Medical Association Vol.284, July 26, 2000, it has been categorically stated that medication errors, unnecessary surgical procedures, adverse side effects of drugs have caused as many deaths as cardiac arrests and cancer. According to a study almost 2, 50,000 deaths were caused owing to iatrogenic reasons. An iatrogenic reason refers to the errors caused by concerned physician in terms of manner, activity as well as the therapy. This is a data which is related to the deaths only. What about the data which is related to the discomfort caused owing to disability and the adverse side effects of medications? Does the government ask the doctors why they make so many fatal errors?

Ironically, even though the American medical cost is one of the highest in the world, the services provided are amongst the poorest. In a recently conducted survey involving 13 countries, the United States ranked 12th from the bottom in terms of the quality of health services provided on the basis of 16 known health indicators. Undoubtedly, after reading the above paragraphs, you would be prompted to ask who is the government actually protecting and why is it doing so? There is one particular incident which I always recall in times like these.
Reading through the FDA laws, you realize that the fda are conveniently hiding a more serious killer in the form of trans fat. Trans fat is found in most processed food items and it is more dangerous than saturated fats. Some scientists are of the belief that it is excessively harmful for the human body as it lowers good cholesterol and aggravates bad cholesterol. It also increases triglycerides and ensures that the blood platelets become far stickier. This causes more clots to form inside a human body. It has also been noticed that even through the saturated fat content in a particular food is low, the trans fat content can be very high.
In the year 1999, as per a cost benefit analysis done for the FDA, it was ascertained that by labelling trans fats on the content section of a food product, it would save $3 billion to $8 billion annually in terms of averted heart disease charges. At the same time, labelling would also save 2000 to 5000 lives annually. Despite all this, FDA has not gone ahead and made it mandatory to label trans fats on food items. This very clearly shows that the labels are actually misleading patients who suffer from cardiac arrests, diabetes, performing athletes and millions of consumers who are conscious of their overall fat intake. Why is the FDA not concerned regarding the labelling of the food products? Are they not bothered about the essential nutritional fats being mentioned in the labels of food items? Do they really not care that the existing food labels are misleading in nature and can harm the consumers adversely? Perhaps they do not want to trouble the big snack manufacturers. Besides, they always ensure that their hospitals are provided with a steady stream of regular visitors. Who knows about trans fats anyways? Don’t you think that it is fairly easy to target the health and supplement industry as it is not as large as the big snacks manufacturers?
I believe it is much easier to slap unrealistic sanctions on the website industry as it is a smaller industry which is concerned with the real health of individuals. Have you realized that every time FDA tries to ensure that food supplements be bought only on the basis of prescriptions, the public reacts in an adverse manner? The public outcry is tremendous and we see petitions being signed, calls being placed and letters being sent on a regular basis. It is owing to the public indignation that the government has had to back of time and again. But now, it seems that they have finally found a way to gain a foothold by slipping the suppression of nutritional information from under the very eyes of the general public. They think you would never know, that you would never notice and that they would be able to take one small step at a time and pass one regulation after another right under your nose. If you allow this to happen then it would not be long before FDA would take complete control over your health decisions.
You need to ask the question whether the government is actually concerned about your health or is it doing so to fill its own pockets? Is it satisfying you pockets
or the pockets of the drug as well as the flourishing medical industry? If you ask this question to yourself, you would have an immediate answer.
Don’t allow the FDA to take complete control over your health. You cannot have them steal your choices. Fight for your rights as you have the right to live freely and choose the supplements of your liking.
If you do not speak out as an individual, the government would take control of all your health decisions and then the day would not be far when you would have to seek permission from the FDA for even complaining to the doctor that you have a headache.
